ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 294(b), 506(i) of IPC and Section 3 of TNPPDL Act in Crime No.14 of 2017 on the file of the respondent Police, seeks anticipatory bail. 2.
The case of the prosecution is that on 16.02.2017 at about 08.00 p.m., when the defacto complainant standing near the colony higher secondary school, one Tata Ace vehicle dashed against the bus stop shed wall and caused damage to the same worth about Rs.2,000/- and the defacto complainant questioned the same, the petitioner used filthy language and threatened the defacto complainant. 3.The learned counsel for the petitioner submitted that the petitioner is innocent person and he have been falsely implicated in this case.
4.The learned Government Advocate (Crl.side) appearing for the respondent Police on instruction would submit that there is no previous offence against the petitioner and the investigation is still pending.
5.Having regard to the nature of allegation levelled against the petitioner and considering the submissions made by the learned Government Advocate (Crl.side), I am inclined to grant anticipatory https://hcservices.ecourts.gov.in/hcservices/
bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of 15 days from the date on which the order copy is made ready, before the learned Judicial Magistrate No.I Kovilpatti, on condition that the petitioner shall execute a bond for a sum of Rs.15,000/- (Rupees fifteen thousand only) with two sureties each for a like sum to the satisfaction of the respondent Police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that: (i) the petitioner shall report before the respondent Police as and when required for the purpose of investigation.; (ii) the petitioner is directed to pay a sum of Rs.3,000/- to the Block Development Officer, Karungulam, Tirunelveli, to enable concerned the Block Development Officer to rectify the damage caused by the petitioner;
(iii) the petitioner shall not tamper with evidence or witness either during investigation or trial;
(iv) the petitioner shall make themselves available for interrogation including custodial interrogation as and when required by the investigation officer;
(v) the petitioner shall not commit any offence while on bail; (vi) on breach of any of the aforesaid conditions, the petition for anticipatory bail stands dismissed.
