ORDER : The Court Made the following order :- The petitioner, who is A7, apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Sections 8 (c) r/w 20(b)(ii)(B) of NDPS Act, on the file of the respondent police and hence, seeks anticipatory bail.
2. The case of the prosecution is that on 09.03.2015 when the police party conducted the search, A1 to A4 were found in possession of 3 kgs ganja.
3. The learned counsel appearing for the petitioner submitted that this petitioner has not committed any offence as alleged by the prosecution. It is further submitted by the learned counsel for the petitioner that the contraband was recovered from the accused Nos.1 to 4.
4. The learned Government Advocate (criminal side) appearing for the respondent submitted that the petitioner is not having previous case on similar nature and the contraband was recovered from the accused Nos.1 to 4, who are already arrested and remanded to the judicial custody.
5. Considering the above said submissions, this court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Principal Special Court for E.C and N.D.P.S. Act Cases, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judge concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m. until further orders.
