ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 and A3, apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 506(i), 452, 427, 406 and 420 IPC, in Crime No.216 of 2017, on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that the petitioners received money from the de-facto complainant for purchasing the property in the name of the de-facto complainant, but the petitioners did not purchase the property and when the de-facto complainant demanded her money, the petitioners brutally attacked the de-facto complainant and caused injuries.
3.The learned counsel for the petitioners submitted that the petitioners are innocent and they did not commit any offence as alleged by the prosecution. However, the learned counsel for the petitioners admitted that there is a money dispute between the petitioners and the de-facto complainant.
4.The learned Government Advocate (Crl.side) appearing for the State submitted that huge money was received from the de-facto complainant on promise to purchase the property in her name. However, the said property was not purchased in her name, the same https://hcservices.ecourts.gov.in/hcservices/
was questioned by the de-facto complainant, the petitioners assaulted the de-facto complainant and caused injuries and the investigation is pending.
5.Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners. Hence, the Criminal Original Petition is dismissed.
