ORDER : The Court Made the following order :- The petitioner/Accused No.1, who was arrested and remanded to judicial custody on 12.09.2017 for the alleged offences punishable under Sections 3 of Tamil Nadu Public Property (Prevention of Damages and Loss) Act, 1992 and Section 379 of IPC, in Crime No.498 of 2017 on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that the respondent police while he was on patrol duty, he intercepted the vehicle, which was illegally transported the sand, without any valid permit. On complaint, case has been registered for the above said offences. 3.The case of the petitioner is that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. 4.

The learned Additional Public Prosecutor submitted that while the respondent police was on patrol duty, the petitioner was found in possession of sand and the investigation is pending. 5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the https://hcservices.ecourts.gov.
