For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.2 of 2019 on the file of the Respondent Police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal Side) appearing for the respondent.

2.The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 408, 409, 471, 477((A) of I.P.C., in Crime No.2 of 2020 on the file of the respondent police, seeks anticipatory bail. 3.The petitioner herein is a salesman in the Chinnamuthandipatti Primary Agricultural Co-operative Credit Society. Enquiry had been initiated under Section 81 of the Tamil Nadu Co-operative Societies Act. The petitioner and others found guilty of causing financial loss to the society to the tune of Rs.27,40,991, which includes cash deficit and shortage of gold, for which criminal prosecution has been launched. https://hcservices.ecourts.gov.in/hcservices/

CRL OP(MD). No.4204 of 2020 4.The respondent police has registered a case in crime No.2 of 2019 for the offence under Sections 408, 409, 471, 477(A) IPC and investigated the matter. At this juncture, the petitioner filed this petition for anticipatory bail stating that he is only a salesman whereas jewels were kept in the locker and 1⁄2 km away from the place of his work. A1 and other person holding the key and they are responsible for the shortage of the cash and gold. 5.The learned Government Advocate(Criminal side) would submit that only after detail enquiry under Section 81 of the Act, criminal case has been registered and the investigation is in preliminary stage and if the petitioner is granted with bail, there will not be any progress in the investigation.

6.Taking note of the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner.
