ORDER : The Court Made the following order :- The petitioner is A1 and she was arrested and remanded to judicial custody on 14.02.2015 for the alleged offences punishable under sections 406 and 420 of IPC, in Crime No.43 of 2015 on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that accused persons had arranged the loan to the de-facto complainant and when the amount was repaid in instalments, the accused have not remitted the same with the account of the Bank concerned.
3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent lady and she has not committed any offence as alleged by the prosecution and she has been in judicial custody from 14.02.2015. He further submitted that the co-accused/A2 was granted bail by this court in Crl.O.P(MD)No.6415 of 2015, dated 08.04.2015. 4.Heard the learned Government Advocate (Criminal side) appearing for the respondent.
5.Considering the facts and circumstances of the case and also considering the period of incarceration by the petitioner, this Court is https://hcservices.ecourts.gov.in/hcservices/ inclined to grant bail to the petitioner with certain conditions.
6.Accordingly, the petitioner is ordered to be released on bail, on her executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Kamuthi, Ramnad District and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. sd/- 13/04/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
