PRAYER : TO ENLARGE THE PETITIONER HEREIN ON BAIL IN CONNECTION WITH THE CASE IN SC NO.22/2023 BEFORE THE LEARNED IIIRD ADDITIONAL SESSIONS JUDGE, TIRUNELVELI IN CRIME NO.118/2013 ON THE FILE OF THE RESPONDENT POLICE.
ORDER : The Court Made the following order :- The respondent Police has registered a case as against the petitioner in Crime No.118 of 2013 for the offence punishable under Sections 120B, 147, 148, 341, 302 r/w. 149 of IPC. After the completion of investigation, a final report has been filed in PRC No.28 of 2014 before the learned Judicial Magistrate No.V, Tirunelveli. Due to nonappearance of the petitioner for hearing on 11.11.2021 in PRC No.28 of 2014, the learned Judicial Magistrate No.V, Tirunelveli, issued a Non Bailable Warrant on 1/3
29.06.2022, based on which, the petitioner was arrested on 01.08.2022 and remanded to judicial custody on the same day. Therefore, he has filed this petition seeking bail.
2. The learned counsel appearing for the petitioner submits that the case has been committed to the Sessions Court on 13.12.2022 and it was taken on file in S.C.No.22 of 2023 by the learned III Additional Sessions Judge, Tirunelveli. However, the petitioner is still in jail from 01.08.2022. Therefore, he prays for grant of bail.
3. The learned Additional Public Prosecutor appearing for the respondent Police submits that this is sixth bail application and the petitioner is having thirty (30) previous cases. Therefore, the earlier bail applications filed by the petitioner were rejected by this Court by considering the antecedent of the petitioners.
4. Considering the antecedent of the petitioner and as there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original Petition is dismissed. The trial Court is directed to expedite the trial in S.C.No.22 of 2023 and conclude the same as expeditiously as possible.
