For Petitioner : Mr.V.Meenakshi Sundaram For Respondents : No Appearance COMMON ORDER These Civil Revision Petitions are filed challenging the orders passed in the amendment application seeking to amend the plaint filed by the respondents and the time extension application filed by the petitioner on the file of the District Munsif, Nanguneri in I.A.No.1 of 2019 and 2 of 2020 dated 07.11.2020 and 24.11.2020.
2.The learned counsel for the petitioners in both petitions submits that the respondents have filed an amendment application seeking to amend the plaint after filing oft the written statement by the petitioner herein. However, the said amendment application was allowed on payment of costs. 3.The learned counsel for the petitioner further submits that the petitioner has filed an application to file additional written statement. The said application was allowed on payment of costs. Since the costs was not paid in time, the petitioner filed an application seeking extension of time. 2/4
However, the said extension application was dismissed and it is not sustainable. The learned counsel for the petitioner fairly submits that it would be suffice if liberty is granted to the petitioner to file additional written statement.
4.In view of the above said submission, these Civil Revision Petitions are dismissed with liberty to the petitioners to file an application for filing additional written statement on the basis of the admission made by P.W.1. On filing such such application, the trial Court is directed to dispose of the same on merits and in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
