PRAYER :- for Bail in Crime No.11 of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal Side) appearing for the respondent.

2. The petitioner is in custody since 06.01.2020 for the offences punishable under sections 294(b), 302 and 307 of IPC of I.P.C., in Crime No.11 of 2020 on the file of the respondent police. He seeks bail.

CRL OP(MD). No.4302 of 2020 3.The petitioner's earlier petition was dismissed by this Court on 21.02.2020. The petitioner's wife is the deceased in this case.

4.I went through her dying declaration. She had categorically stated that though theirs was a love marriage, the deceased used to torture her almost on a daily basis citing her childlessness. On the occurrence date i.e., 05.01.2020, the petitioner is said to have poured petrol on her and set fire to her.

5.The petitioner's counsel would claim that the petitioner also suffered, while trying to rescue her. It is possible that while setting fire to the deceased, the petitioner sustained burn injuries.

6.In view of the gruesome nature of the occurrence, I dismiss the petitioner's earlier bail petition. There is no change in circumstance. Hence, this criminal original petition stands dismissed.
