ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1, A2 and A4, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 8(1)(c) r/w.20(b)(ii) of the NDPS Act, in Crime No.170 of 2015 on the file of the respondent police and hence, seek anticipatory bail.

2.The allegation against the petitioners is that they were found in possession of 1 kg of ganja.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the second petitioner/A2 was arrested and the third petitioner is a lady and she is having one previous case.

4.The learned Government Advocate (Crl.side) would submit that A1 and A2 are having four previous cases and the third petitioner/A4 is having one previous case.

5.Insofar as the petitioners 1 and 2/A1 and A2 are concerned, this petition is dismissed and this Court is inclined to grant anticipatory bail to the third petitioner with certain conditions. 6.Accordingly, the third petitioner is ordered to be released on bail in the event of arrest or on her appearance before the Additional District and Sessions Judge, Presiding Officer Special Court for E.C and NDPS Act cases Court, Pudukkottai and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judge concerned and on further condition that the third petitioner shall appear before the respondent police daily at 10.00 a.m until further orders. The third petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The third petitioner shall appear before the concerned Judge within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 23/04/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
