ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.13, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 302, 120(b), 147, 148, 341, 506(ii) and 201 of I.P.C., in Crime No.33 of 2015 on the file of the respondent police and hence seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the accused have attacked the deceased with a lethal weapons and caused his death.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and there is no material against this petitioner for commission of the offences.

4. The learned Government Advocate (Crl.side) submitted that the accused Nos.2, 3, 5 and 12 are still absconding and the petitioner is having specific overt act. It is further submitted that the petitioner is one of the conspirator and he aided money for the commission of offence.

5. Considering the nature of allegation, this Court is of the view that the petitioner is not entitled for anticipatory bail at this stage.
