ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 448, 355 and 506(i) of IPC and Section 4 of Tamil Nadu Prohibition of Women Harassment Act , in Crime No.102 of 2018, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that, on 18.03.2018, in a wordy quarrel between the petitioner and defacto complainant and that the petitioner made life threat to the defacto complainant. Hence, the case has been registered for the above said offences.
3. It is submitted by the learned counsel for the petitioner is that the petitioner is innocent and that the petitioner has falsely implicated in this case, and prays for anticipatory bail in favour of the petitioner.
4. The learned Government Advocate (Criminal side) submitted that that there is no previous case registered against the petitioner.
5. Considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be https://hcservices.ecourts.gov.in/hcservices/
released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Pattukottai and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
