Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to grant permission and necessary protection to perform the temple pooja festival on 03.06.2019 between at 08.00 A.M. to 11.00 A.M. and on 05.06.2019 at 04.00 p.m., 10.00 p.m., 06.06.2019 at 01.00 A.M., 02.00 A.M., to 07.00 A.M., and 10.00 A.M., 04.00 P.M. to 05.00 P.M. and 10.00 P.M. and on 07.06.2019 at 08.00 P.M., in which several programs will be held in the temple of Arulmighu Sree Muthalamman Thirukoil Thiru Vizha at Thethampatti Village, Natham Taluk, Dindigul District, by considering the representation of the petitioner dated 29.05.2019 sent to the respondents.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents to grant permission and also police protection to conduct the temple festival of Arulmighu Sree Muthalamman Thirukoil Thiru Vizha at Thethampatti Village, Natham Taluk, Dindigul District, on 03.06.2019, 05.06.2019, 06.06.2019 and 07.06.2019. https://hcservices.ecourts.gov.in/hcservices/

2. Heard Mr.R.Suresh Kumar, learned counsel appearing for the petitioner and Mr.K.K.Ramakrishnan, learned Additional Public

Prosecutor, who takes notice on behalf of the respondents.

The grievance of the petitioner is that the petitioner and all the villagers are celebrating the temple festival of Arulmighu Sree Muthalamman Thirukoil Thiru Vizha at Thethampatti Village, Natham Taluk, Dindigul District as per the tradition and custom. For conducting the temple festival peacefully and also seeking police protection, the petitioner has given a representation before the respondents on 29.05.2019. The said representation was not considered and no order has been passed so far. Hence, the present Writ Petition has been filed seeking the aforesaid relief.

Today, when the matter came up for hearing, the learned Additional Public Prosecutor appearing for the respondents, on instructions, submitted that since there is a dispute between two rival groups, a peace committee meeting was already conducted by the Tahsildar, Natham Taluk, in which, both parties are agreed to conduct the temple festival peacefully. The second respondent police is also willing to give police protection for conducting the festival.

5. In view of the submission made by the learned Additional Public Prosecutor appearing on behalf of the respondents and also considering the fact that the second respondent police is willing to give police protection, this Court is of the view that no further order is required in this Writ Petition. Hence, the Writ Petition is closed. No costs.
