Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to return petitioner's original driving license bearing D.L.No.TN09 19950002983 so as to enable him to continue his service in the second respondent Transport Corporation based on the petitioner's representation dated 19.02.2020 within a time limit that may be fixed by this Court.

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 2.The petitioner is the owner of Driving license No.TN09 19950002983. Unfortunately, when he was driving the Transport Corporation Bus bearing Registration No.TN 67 N 0770 from Melaperumal Patti to Periyar Bus Stand, the petitioner dashed one Hero Maestro 125 Scooter bearing Registration No.TN 59 CW 0220 and caused the accident and more unfortunately, the driver of the Scooter died on 25.12.2019. A First Information Report came to be registered against the petitioner in Crime No.661 of 2019, under Sections 279 and 337 IPC. His license was confiscated. W.P(MD)No.4777 of 2020 possession is with the first respondent namely, The Regional Transport Officer/ The Licensing Authority, Regional Transport Office, Madurai South, Madurai.

The petitioner gave a representation on 19.02.2020 seeking return of the original driving license. The petitioner has been suspended from driving any vehicle of the Transport Corporation.

3.It is stated by the learned Counsel that the said period would come to an end on 25.03.2020. It is in the interest of the petitioner, he does not drive any vehicle, during the period of suspension either voluntarily or un-voluntarily or by over sight. 4.A direction is given to the first respondent to keep the driving license No.TN09 19950002983 in safe custody and return the same to the petitioner on proper identification and acknowledgement on 26.03.2020 or 27.03.2020. On either one of the two dates, the petitioner may make a short visit to the Regional Transport Officer/ The Licensing Authority, Regional Transport Office, Madurai South, Madurai, and the petitioner may identify himself and seek return of original license.

5.With the above direction, the writ petition is disposed of. No costs.
