This writ petition has been filed seeking the issuance of a writ of mandamus, directing the first respondent to consider the petitioner's representation dated 23.06.2025 and further to direct the respondents to refix the fair compensation based on today's market price of Rs. 30,00,000/- (Thirty Lakhs) per cent for the petitioner's land acquired in Land Survey Nos. 175/4B, 175/21B, Nalloor Village, Vilavancode Taluk, Kanyakumari District, within the stipulated time. 2.Heard the learned counsel for the parties and perused the available materials on record.
3. Earlier, this Court instructed the learned Government Advocate appearing for respondents 1, 2, 5, and 10 to obtain instructions as to whether the compensation award had been passed in the present case. Today, when the matter was taken up for hearing, the learned 3/7
Government Advocate submitted that the award has not been passed till date in respect of the acquired subject land. He further submitted that the second respondent/District Collector would consider and dispose of the petitioner's representation dated 23.06.2025 within the time frame stipulated by this Court.
4. In view of the aforesaid submission, without expressing any opinion on the merits of the matter, this Court directs the second respondent/District Collector to consider and dispose of the petitioner's representation dated 23.06.2025 after conducting an enquiry, which shall include issuing notice to the petitioner and to any other persons who may be affected and considering any objections submitted by them. The second respondent shall thereafter pass the final award in respect of the acquired land. This exercise shall be completed within a period of sixteen weeks from the date of receipt of a copy of this order. No costs.
