ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.13, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 465, 468, 471, 472 and 420 IPC, in Crime No.37 of 2016, on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that without having any valid title to the property, the accused persons created documents and made seal of the Tahsildar and created forged document and sold the property to the de facto complainant. On complaint case has been registered for the above said offences.

3.When the Criminal Original Petition was taken up for hearing on 30.06.2016, there was no representation on the side of the petitioner and therefore this petition was posted today under the caption for dismissal and even today, there is no representation on the side of the petitioner. Therefore, this petition is disposed of on merits on the basis of the arguments advanced by the learned Government Advocate (Criminal side).

4.The learned Government Advocate (Criminal side) submitted that without having any valid title to the property, the accused persons created documents and made seal of the Tahsildar and created forged document and sold the property to the de facto complainant. If the petitioner is released on anticipatory bail, he will tamper the evidence and hamper the investigation.

5.Considering the facts and circumstances of the case and also considering the serious nature of allegation made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly this petition is dismissed. sd/- 12/07/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
