ORDER
This Criminal Original Petition has been filed, invoking Section 1/4
482 Cr.P.C., seeking orders to direct the second respondent not to harass the petitioner and his family members.
2. The learned counsel appearing for the petitioner would submit that the petitioner is the husband of the third respondent and that she has lodged a false complaint against the petitioner and on that basis, the second respondent has directed the petitioner to appear before them again and again. He would further submit that HMOP is pending between the parties.
3. The learned Government Advocate (Criminal Side) appearing for the respondents 1 and 2 would submit that on the basis of the complaint given by the third respondent, enquiry was conducted and the same was ordered to be closed. He would further submit that the third respondent has lodged a complaint stating that the petitioner has purchased some poisonous substances from Amazon and attempted to make her to consume the same and that they have already referred the matter to the Social Welfare Officer.
4. Despite the specific allegation made in the complaint, this Court 2/4
is at loss to understand why the matter was referred to the Social Welfare Officer. Whatever it is, the second respondent is directed to consider the complaint and follow the dictum laid down in the case of Lalita Kumari Vs. Government of Uttar Pradesh and Others reported in (2014) 2 SCC 1 and proceed in accordance with law.
5. With the above direction, this Criminal Original Petition stands disposed of.
