Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A5, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 341, 302 r/w 120(B) of IPC., in Crime No. 56 of 2017, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that A5 prevented the deceased person to escape from the other accused persons, thereby the other accused persons involved in the crime, brutally attacked the deceased person and sustained grievous injuries, which lead to the death of the deceased person.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he is no way connected with the offence as alleged by the prosecution.

4. The learned Government Advocate (Crl.Side) appearing for the State would submit that the investigation is still pending and hence, he opposed to grant anticipatory bail in favour of the petitioner.

5. Considering the gravity of offence, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this petition is dismissed.
