ORDER
The present Writ Petition has been filed for issuance of a Writ of Certiorari, to quash the impugned proceedings of the 1st respondent dated 14.02.2023.
2. The petitioner has challenged the show cause notice. It is a settled law that writ is not maintainable against show cause notice. But in the present case, show cause notice was issued under Section 77A of the Registration Act. The said section is held ultravires. Therefore, the said impugned show cause 2/4
notice is issued without jurisdiction. Hence, the impugned show cause notice is liable to be quashed.
3. Accordingly, this writ petition is allowed. The impugned show cause notice dated 14.02.2023 is hereby quashed. The parties are at liberty to approach the appropriate civil Court to agitate their rights. There shall be no order as to costs.
