PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 & 2 to implement the order of the Labour Court, Madurai, Virudhunagar Camp, in I.D.No.45 of 2015, dated 11.10.2023, by considering the petitioner's representation dated 12.02.2025, within the time stipulated by this Court.

O R D E R

This writ petition has been filed by the petitioner seeking a direction to the respondent - Transport Corporation to implement the award dated 11.10.2023, passed in I.D.No.45 of 2015, on the file of the Labour Court, Madurai, Virudhunagar Camp.

2. This matter came up for consideration on 24.02.2025 and the same was adjourned to enable the learned Standing Counsel appearing for the respondent - Transport Corporation to get instructions as to whether the respondent - Transport Corporation has challenged the said award dated 11.10.2023 or not.

3. Today, when the matter is taken up for consideration, learned Standing Counsel appearing for the respondents submitted that the respondents, so far, have not challenged the said award dated 11.10.2023, however, the matter is pending for consideration as to whether the respondent - Transport Corporation should challenge the said award or not.

4. In the light of the above, it is evident that the award, which is sought to be implemented, is in force as on date and it was passed as early as on 11.10.2023. So long the said award is in operation, the respondent - Transport Corporation is bound by the same and they cannot escape from implementing the same.

5. In the light of the above, the respondent - Transport Corporation is directed to give effect to the award dated 11.10.2023, passed in I.D.No.45 of 2015, on the file of the Labour Court, Madurai, Virudhunagar Camp, within a period of three months from the date of receipt of a copy of this order. However, this order will be subject to the condition that the said award is in force.

6. Accordingly, this writ petition is disposed of. No costs. 25.02.2025 NCC :
