ORDER

This Criminal Original Petition has been filed to direct the learned III Additional District and Sessions Judge (PCR Court) at Madurai District, to consider and pass orders on bail application to be filed by the petitioner in connection with Crime No.43 of 2026 pending on the file of the second respondent on the same day of surrender. 2.Since there is no adverse order passed against the 3rd respondent, notice to the 3rd respondent is dispensed with. 3.The case of the prosecution is that the defacto complainant is a local financier lending money at the rate of interest to the local people. The petitioner's sister's son, who is arrayed as A1 in this case and one 2/6

Vignesh, who is the second son of the defacto complainant, are close friends. Due to their friendship, the defacto complainant lent a sum of Rs.2 lakhs to A1 for his family's emergency medical expenses at the rate of 2% per annum and A1 promised to repay the said amount within two months. After two months, A1 failed to repay the principal amount and interest. On 29.01.2026, at about 09.30 p.m., due to a money dispute, the petitioner and the other accused persons trespassed into the house of the defacto complainant, where the defacto complainant and her daughter, who is a special child, were living alone and attacked the defacto complainant and her sons with wooden logs and stones. Upon the defacto complainant raising an alarm, nearby persons came to the spot and the petitioner and the other accused persons fled from the place of occurrence. Based on these allegations, an FIR has been registered against the petitioner.

4.Heard the learned counsel on either side and carefully perused the materials available on record.

5.Considering the limited scope of the relief sought for, this Court hereby directs the learned III Additional District and Sessions Judge (PCR Court) at Madurai District, to issue prior notice to the defacto complainant and thereafter to consider the bail application of the petitioner on the same day of her surrender before that Court in connection with Crime No.43 of 2026 on the file of the 2nd respondent police.
