For Respondent : Mr.S.S.Manoj, Government Advocate (Crl.Side) PRAYER :- For Anticipatory Bail in Crime No.45 of 2026 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 324(4), 115(2), 127(2), 1/4

118(1), 296(b), 132, 351(2) of BNS 2023, in Crime No. 45 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is the Village Administrative Officer. The accused persons submitted an application before the authorities to issue "rural area" certificate. The officials have informed that the BDO office only got the power to entertain such application. The petitioner and other accused persons went to the office and abused the defacto complainant using filthy language and attacked him using hands, legs and scale. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. 2/4

4. The learned Government Advocate (Crl. side) submitted that there are two accused, they are father and son and both of them attacked the VAO and there is no security for the Government officials. Hence, he vehemently objected for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, and the nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
