ORDER
The writ petition is filed seeking a direction to the 2nd respondent to consider his representation dated 15.07.2022.
2. Heard the learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing on behalf of the respondents.
3. According to the petitioner, the Patta for the subject property in S.No.380/2B originally stood in the name of the petitioner's father and mother namely Ramar and Lakshmi in Patta No.404. However, one Thangam based on invalid documents obtained Patta in his name. Therefore, the petitioner submitted a representation on 15.07.2022, before the Revenue Divisional Officer, Sivakasi, seeking cancellation of Patta issued in the name of the above said Thangam and restoration of Patta in the name of petitioner's parents namely Ramar and Lakshmi. Pursuant to the said representation submitted by the petitioner, Sub Collector, 2/6
Sivakasi in his proceedings dated 23.09.2024 in e/f/m1/1685/2014 called for report from the 2nd respondent. Thereafter, there is no progress in the matter. Therefore, the petitioner has come before this Court in the above mentioned prayer.
4. The learned Additional Government Pleader who appeared for respondents would submit that the 2nd respondent will submit his report before the Sub Collector, Sivakasi within the time stipulated by this Court.
5. In view of the same, without expressing any opinion on the merits of the matter, the 2nd respondent is directed to submit his report before the Appellate Authority viz., the Sub Collector, Sivakasi within a period of six
(6) weeks from the date of receipt of a copy of this order. The said authority viz., the Sub Collector, Sivakasi shall consider the representation of the petitioner dated 15.07.2022 and pass final orders within a further period of twelve (12) weeks, after issuing notice to the petitioner, the above mentioned Thangam and other interested parties. 3/6
6. The writ petition is disposed of with the above observations and directions. No costs. Consequently, connected miscellaneous petition is closed.
