ORDER

The present writ petition has been filed seeking a mandamus forbearing the respondents 1 to 3 from laying any road in the petitioner's patta land in S.No.20/5A1 in Neerathan Village, Vadipatti Taluk, Madurai District.

2. The petitioner has produced a patta standing in the name of his father in patta No.897 for the above said survey number. Hence, he contended that the respondent officials are trying to put up a road in the private property.

The learned Additional Government Pleader appearing for the third respondent, on instructions, submitted that adjacent survey number, namely, S.No.20/5A2 is a Panchayat Union road and therefore, they are laying the road only in the said survey number and not in the survey No.20/5A1. However, the learned Counsel appearing for the petitioner submitted that there is likelihood of encroachment by the third respondent while laying the road into his private property.

4. In view of the above said facts, the second respondent is directed to conduct a survey in the presence of the writ petitioner and verify that no road is laid in survey No.20/5A1. Before completing the survey, the road shall not be laid in S.No.20/5A1.
