For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- for Anticipatory Bail in Crime No.5 of 2020 on the file of the respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Criminal Side) appearing for the respondent.

2.The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under section 420 of I.P.C., in Crime No.5 of 2020 on the file of the respondent police, seek anticipatory bail.

3.Against the petitioners one Koppammal has given a complaint to the respondent police on 08.01.2020 alleging that the petitioners herein promising job to her son in a foreign country, received a sum https://hcservices.ecourts.gov.in/hcservices/

CRL OP(MD). No.4229 of 2020 of Rs.1,56,000/- and passport of her son, during the month of August, 2018 and thereafter, they did not arrange job and also did not return the passport.

4.The petitioners, who arrayed as A1 and A2, in their anticipatory bail petition contended that the passport and a sum of Rs.1,56,000/- received from the defacto complainant for arranging job in foreign country. However, the said amount was not given to the petitioners and they were only mediators. After this complaint, they have returned a sum of Rs.56,000/- and passport to the son of the defacto complainant. In the said circumstances, they seek for anticipatory bail.

5.First Information Report prima facie reveals that the petitioners running agency for secuing job and received money as well as the passport from the defacto complainant's son. Now after complaint, it is stated that they have returned back a sum of Rs.56,000/-. Till a sum of Rs.1,00,000/- is pending. In any event, had the petitioners promised to arrange job in foreign country without permission from the concerned authorities, it is a matter for investigation. Anticipatory bail cannot be granted in the matter of this nature. Hence, this criminal original petition is dismissed.
