Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent to grant permission for conducting Aadl Padal cultural program scheduled from 12.06.2019 to 14.06.2019 in pursuance to the pongal festival of Sri Kaliamman and Sri Mariamman temple situated at Thummanaickanpatti, Peraiyur Post & Taluk, Madurai Disrict and consequently to provide adequate protection to the temple festival scheduled from 11.06.2019 to 14.06.2019 on the basis of the representation dated 28.05.2019. ORDER

When the matter was taken up for hearing the learned Government Advocate (Criminal Side) appearing for the respondents submitted that due to dispute between two religious groups, it may not be advisable to permit the holding of the petition mentioned event. Thereupon, the petitioner's counsel drew the attention of this Court to the order dated 12.06.2018 made in W.P.(MD)No.12059 of 2018 filed by the very same petitioner herein. This Court had permitted the petitioner to submit a fresh representation and the second respondent was called upon to pass orders thereon. The petitioner's counsel states that the second respondent had permitted the holding of the event and that the event was conducted smoothly. This submission made by the learned counsel for the petitioner is confirmed by the second respondent police also.

2.The petitioner undertakes through his counsel that he would abide by any of the condition that may be imposed by the second respondent to ensure the smooth conduct of the event in question.

3.Recording the said submission, this writ petition is allowed. It is open to the second respondent to incorporate such conditions as he deems fit to ensure the smooth conduct of the event. No costs.
