PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to set aside the order dated 29.11.2024 passed by the Sub Court, Sattur in unnumbered I.A. of 2024 in O.S.No.39 of 2024 and to direct the Sub Court, Sattur, to number the said I.A.

ORDER

The plaintiff in O.S.No.39 of 2024, on the file of the Sub Court, Sattur, is the revision petitioner herein.

2.The said suit was dismissed for default on 29.11.2024. For restoration of the suit, an application came to be filed within 30 days. However, the said application was returned by the office, raising certain objections with regard to the pleadings in paragraph Nos.5 and 6 of the said affidavit. Challenging the said return order, the present revision petition has been filed. 3.Considering the fact that the application for restoration of the suit has been filed in time, the petitioner is directed to represent the said application after deleting the objectionable portions in Paragraph Nos.5 and 6. On such representation, the Sub Court, Sattur, is directed to number the same and proceed in accordance with law.

4.The original impugned order shall be returned to the learned Counsel appearing for the petitioner after obtaining due acknowledgment from the learned Counsel appearing for the petitioner. 2/4

5.With the above said observations, this Civil Revision Petition stands disposed of. No costs.
