O R D E R

This Civil Revision Petition has been filed challenging the order dated 17.12.2022 passed in I.A.No.105 of 2017 in I.D.O.P. No.10 of 2016 by the learned Family Court, Tiruchirappalli.

2. The learned counsel for the revision petitioner submitted that the Trial Court, without properly verifying the relevant facts, had adjudicated the matter by erroneously recording that the couple had two children. The learned counsel appearing for the revision petitioner-husband contended that, out of the wedlock, only one son was born to the parties and that the said son is also residing with him, and that such factual error has materially affected the impugned order.

3. Apart from the above, it was submitted that the respondent-wife is working as an Accountant in a private company and is drawing a sum of Rs. 7,500/- per month, which fact has not been disputed by the respondent and is evident from the records placed before the Court. 2/6

4. Though the Family Court had directed payment of Rs.9,000/- as interim maintenance, this Court, by order dated 02.03.2023, modified the same to Rs.6,000/-. The learned counsel for the revision petitioner further submitted that the petitioner is drawing a monthly salary of only Rs.18,000/- and is taking care of the minor child, and undertook that he would abide by the interim direction passed by this Court regarding payment of interim maintenance. Hence, the interim maintenance fixed by this Court at a sum of Rs.6,000/- per month is hereby confirmed.

5. The revision petitioner is further directed to deposit the remaining maintenance amount, if any, due. Upon such deposit, the respondent is at liberty to withdraw the same with the leave of the Trial Court.

6. With the above direction, this Civil Revision Petition stands closed. No costs. Consequently, the connected Miscellaneous Petition is closed. 05.02.2026 Speaking : Yes / No NCC : Yes / No Internet : Yes / No Index : Yes / No 4/6
