PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondent no. 1 to 3 to provide adequate police protection to the petitioner and the residents who are residing in the north street, Thennamanadu South, Thanjavur District on the basis of the petitioner's representation dated 27.01.2025 and 05.02.2025 in accordance with law. O R D E R
This Writ Petition has been filed seeking a direction to the respondents 1 to 3 to provide adequate police protection to the petitioner and the residents, who are residing in the north street, Thennamanadu South, Thanjavur District on the basis of the petitioner's representation dated 27.01.2025 and 05.02.2025.
2.According to the petitioner, the land in S.No.717/1 and 717/2 in North Periyakulam, Thennamanadu, Orathanadu Taluk, Thanjavur District is a pond to an extent of 2 acres and 28 cents. While so, 2/6
individuals one Ramesh, Mathavi Gangatharan and Narayanan had encroached upon the pond and built a house and established shops, hotels and the remaining land was converted into agricultural land. The local authorities failed to remove the encroachments for the past 18 years. Therefore, the petitioner has filed a petition in W.P(MD)No.1558 of 2020, seeking to remove the encroachment and subsequently, the fourth respondent has also filed a petition in W.P(MD)No.3884 of 2020 to quash the order of eviction passed by the Block Development Officer, Orathanadu. This Court disposed of both the writ petitions. Then, the petitioner sent a representation to the District Collector on 06.01.2025 along with a copy of the order passed in W.P(MD)No.1558 of 2020 seeking to remove the encroachment. The District Collector also issued a communication in Na.
Ka.No.3278/2024 by directing the authorities to remove the encroachments. Thereafter, again the fourth respondent has filed a writ petition in W.P(MD)No.3064 of 2025 challenging the eviction order passed by the Tahsildar and to grant patta to him. However, the said petition was dismissed on 27.01.2025. Thereafter, the petitioner faced numerous threats from respondents 4 to 7 and their associates. Therefore, he appeared before the respondents 1 to 3 in person and gave the representation and on 05.02.
and requested to provide police protection for the life and limb of the petitioner, but the same has not been considered. Hence this petition has been filed.
3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the representation of the petitioner is under enquiry and they will consider the representation and dispose of the same, within a week.
4.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondents, is inclined to pass order.
5.Since the third respondent has admitted the receipt of the petitioner's representation, the third respondent is directed to complete the enquiry and dispose of the petitioner's representation, within a period of one week in accordance with law.
