O R D E R
The learned Counsel for the Petitioner submits that the Petitioner is the defacto Complainant in Crime No.714 of 2023 on the file of the second Respondent. The Petitioner had filed this Petition seeking direction against the second Respondent to complete the investigation. 2.The learned Government Advocate (Crl.side), on instructions of the Respondents 1 and 2, submits that the total amount involved in Crime No. 714 of 2023 is about Rs.73,93,000/-. The case was registered based on the directions of the learned Judicial Magistrate in Cr.M.P.No.238 of 2023 filed under Section 156(3) Cr.P.C., It is his further submission that after registration of the case, the accused in this case had approached the learned Principal Sessions Judge, Madurai, seeking anticipatory bail by filing Crl.M.P.Nos.4818 and 4822 of 2023.
3.As per order dated 24.01.2024, the accused in this case were directed to appear before the Mediation Centre attached to the District 2/4
Court. The persons, who filed Crl.M.P.Nos.4818 and 4822 of 2023, had been arraigned as accused 1 and 2. They undertook to pay the amount in 3 installments within 60 days and paid Rs.14,43,988/-. Therefore, the investigation had not proceeded, since the matter was likely to be settled. 4.In the light of the above, the Petitioner is directed to approach the District Court concerned for appropriate orders.
