: Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India praying for the issue of a Writ of Mandamus to direct the respondents to shift the TASMAC outlet, No.4946 situated at Puliyur Village, Karur Taluk, Karur District to some other suitable place, by considering the petitioner's representation dated 20.10.2020 within a time frame as fixed by this Court.

(Order of the Court was made by M.M.SUNDRESH, J.) Seeking a direction to shift the TASMAC outlet No.4946 by considering the petitioner's representation, this writ petition has been filed.

2. When the matter is taken up for hearing, the learned standing counsel for the TASMAC, on instructions, submitted that there is no violation of distance rules. We cannot conduct a roving https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.5646 of 2021 enquiry with respect to the distance rule, unless until the petitioner has come forward with unimpeachable evidence. This Court cannot exercise the power under Article 226 of the Constitution of India by interfering the process of measurement.

3. Accordingly, the writ petition stands closed. No costs.
