PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 2 to 4 to provide adequate police protection to the employees / worker of the petitioner to remove the metal rope and chain tied in the 33KV transmission line situate at Nagamaptti Village, Tuticorin District so as to enable the petitioner to restore the power generation, on the basis of the representation of the petitioner, dated 06.02.2023 within a time frame fixed by this Court.

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents 2 to 4 to provide adequate police protection to the employees / worker of the petitioner to remove the metal rope and chain tied in the 33KV transmission line situated at Nagamaptti Village, Tuticorin District so as to enable the petitioner to restore the power generation, on the basis of the representation of the petitioner, dated 06.02.2023 within a time frame fixed by this Court.

2. The learned Government Advocate (Crl. Side) takes notice for the respondents. By consent, this writ petition is taken up for final 2/5

disposal at the admission stage itself.

3. The learned Government Advocate (Crl. Side) appearing for the respondents police would submit that on the basis of the representation given by petitioner, dated 10.02.2023 summon has been issued to the fifth respondent herein, but, he has not appeared. Let, again the summon be issued to the 5th respondent, so that he may appear before the third respondent. He further submitted that after his appearance the representation given by the petitioner will be considered by the respondents police.

4. In view of the said submission, the respondents police are directed to consider the representation of the petitioner, dated 06.02.2023 on its own merits within a period of 15 days from the date of appearance of the 5th respondent.
