ORDER

Seeking a direction to the second respondent to provide adequate police protection to the petitioner's life and limb keeping in the view of the 1/5

endangering of the petitioner at the hands of the third respondent herein by considering the petitioner's representation dated 09.02.2026, this petition is filed.

2. Since no adverse order is proposed to be passed against the third respondent, notice to him is dispensed with.

3.The learned counsel appearing for the petitioner submitted that the petitioner had given a representation on 09.02.2026. However, the second respondent police has not taken any action. The petitioner claims that he is in possession of 3 cents of land comprised in S.No. 286/6, Naranapuram Village, Sivakasi Taluk, which exclusively belongs to his wife, namely, Murugalakshmi, who has perfected her title and possession over the same by effecting proper mutation. However, the third respondent is unnecessarily interfering with the peaceful possession and enjoyment of the said property. He further submitted that the third respondent is continuously hindering the ongoing construction in the said land, which has been commenced by the petitioner and his wife, without any rhyme or reason. It is also submitted that the second respondent police is insisting on payment of money as demanded by him. Hence, the present petition has been filed.

4.The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the construction undertaken by the petitioner encroaches upon a portion of land belonging to the Government. It is stated that the villagers, along with the third respondent, conducted a road roko agitation. Based on the same, the second respondent police registered an FIR against the third respondent and 20 other persons. In this regard, the petitioner has not lodged any complaint.

5. Heard the learned counsels on either side and carefully perused the materials available on record.

6.In this regard, the second respondent police are directed to put the petitioner as well as the third respondent on notice and conduct an enquiry and give a quietus to the issue by obtaining necessary explanations from the third respondent on what basis he had conducted a road roko agitation and question the title of the petitioner with respect to the land comprised in S.No.286/6, Naranapuram Village, Sivakasi Taluk, and the petitioner is directed to produce all necessary documents. If the third respondent's action is found to be reckless and without any justification, the second respondent police are directed to 3/5

afford necessary protection to the petitioner on payment of the requisite charges in terms of the G.O.(Ms)No.139, Home (Pol~VIII) Department, dated 04.03.2019.

7. With the above directions, this Criminal Original Petition is disposed of.
