... Respondents Prayer : Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the Contemnors / Respondents herein for the 1/5
deliberate and willful disobedience in implementation of the order made in W.A.(MD).No.981 of 2017, dated 15.03.2018. For Petitioner : Mr.M.Rajarajan For Respondents : Mr.G.V.Vairam Santhosh, Addl. Government Pleader.
ORDER
The petitioner herein had earlier filed W.P.(MD)No.9626 of 2017 challenging the order dated 14.07.2016 issued by the District Revenue Officer, Pudukottai. The said writ petition was taken up along with W.A.(MD)No.981 of 2017 filed by the petitioner herein. By a common order dated 15.03.2018, while the writ appeal was disposed of, the writ petition was dismissed. Thereafter, the first respondent in the writ appeal filed W.P.(MD)No.17095 of 2024. The writ petition was disposed of by one of us (Mr.Justice G.R.Swaminathan) on 25.07.2024 in the following terms:- "2.The petitioner was granted assignment as early as on 09.07.1992. The District Revenue Officer, Pudukkottai issued communication dated 14.07.2016 addressed to the Tahsildar, Thirunmayam to carry out the assignment in the village accounts 2/5
and other revenue records. Challenging the same, one K.Pandidurai filed W.P(MD)No.9626 of 2017. The writ petition was dismissed on 15.03.2018 by the Hon'ble Division Bench. 3.I therefore safely conclude that communication issued by the District Revenue Officer, Pudukkottai mandating the Tahsildar, Thirumayam has become final. The Tahsildar, Thirumayam is directed to implement the communication dated 14.07.2016 of the District Revenue Officer, Pudukkottai. This of course shall be subject to outcome of any civil proceedings that might have been initiated or might be initiated by the concerned parties." 2.By way of implementing the said order, proceedings dated 13.01.2025 have been issued. This will not constitute contempt. Unless the petitioner herein succeeds in getting the earlier orders reviewed, no contempt would lie.
3.Granting such liberty, this contempt petition is closed. (G.R.S. J.,) & (M.J.R. J.,) 07.04.2025 NCC : Yes/No Index : Yes / No Internet : Yes/ No ias 3/5
