ORDER

The prayer in the writ petition is for a Writ of Mandamus to direct the respondent herein to issue a separate patta to the petitioner for his lands to an extent of 1.40.5 Hectares in S.No.604 of Theppampatti Village, Aandipatti Taluk, Theni District by considering his representation dated 28.03.2019. 2.The petitioner, in order to get patta for his land at S.No.604 of Theppampatti Village, had made a request to the respondent Tahsildar on 28.03.2019. In this regard, the learned counsel for the petitioner would submit that the petitioner has paid Kist for the said land and the Village Administrative Officer concerned has given a certificate to that effect pertaining to the possession of the said land. Based on these documents, when the petitioner made request to the respondent Tahsildar, the same has not so far been considered. Therefore, the petitioner is before this Court.

3. Heard the learned Government Advocate, who would submit that the said representation of the petitioner for grant of patta would be considered after conducting due enquiry, of course, with the petitioner as well as other stake holders, and a final decision would be taken by the Tahsildar concerned within a time framed to be stipulated by this Court.

Considering the said submission made by either side, this Court is inclined to pass the following direction: "that the respondent Tahsildar is directed to consider the request of the petitioner dated 28.03.2019 and take a decision thereon by conducting an enquiry with the petitioner and the other stake holders/private parties and pass orders thereon in respect of the grievance of the petitioner, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order."

5. With the above direction, this writ petition is disposed of. No costs.
