PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the 3rd respondent to pass final order in the petitioner society's representation dated 06.10.2015 taken into file by the 3rd respondent in Na.Ka.No.6377/2015/A5/ dated 09.10.2015 in the matter of granting patta to the petitioner society for the 61 cents (0.24.5 Ares) of land in S.No.121/1 of Thottakadu Village, Thanjavur Taluk and District.

ORDER

This writ petition is filed to direct the 3rd respondent to consider and pass final orders on petitioner's society representation dated 06.10.2015.

2.The grievance of the petitioner is that though they made a representation dated 06.10.2015 to the 3rd respondent seeking to issue patta for the property in S.No.121/1, measuring to an extent of 61 cents (0.24.5 ares) situated at Thottakadu Village, Thanjavur Taluk and District, so far, no action has been taken by the 3rd respondent. Hence, the present writ petition. 3.The learned Special Government Pleader appearing for the respondents would submit that in compliance with the directions issued by this Court dated 16.03.2020, the Tahsildar, Thanjavur District, had conducted an enquiry and rejecting the claim of the petitioner, final orders have been passed on 27.07.2020. In that regard, a copy of the proceedings of the The Tahsildar, Thanjavur passed in R.C.No.3400/2020/A5 dated 27.07.2020 has also been produced before this Court. He would further submit that a copy of the rejection order dated 27.07.2020 has already been sent to the petitioner.

4.In reply, the learned counsel appearing for the petitioner would submit that the petitioner has not received any communication from the respondents in that regard, till date. 5.By recording the aforesaid submission made by the learned Special Government Pleader, this Writ Petition is dismissed as infructuous with a direction to the 3rd respondent to serve a copy of the rejection order dated 27.07.2020 to the petitioner, if the same has not been sent to the petitioner already. It is open to the petitioner to challenge the rejection order dated 27.07.2020 before the appropriate forum in the manner known to law. No costs.
