PRAYER:- To extend the time for depositing 50% cheque amount to the credit of C.C.No.199 of 2018 on the file of Judicial Magistrate Court, Rajapalayam by the order of this Hon'ble Court in Crl.M.P.(MD)No. 20310 of 2025 in Crl.R.C.(MD)No.1648 of 2025 dated 18.12.2025. ORDER

The present miscellaneous petition is filed seeking extension of time to comply with the order dated 18.12.2025, wherein this Court in Crl.M.P.(MD)No.20310 of 2025 in Crl.R.C.(MD)No.1648 of 2025 suspended the sentence with the following condition:- "5(i) Petitioners are directed to deposit 50% of cheque amount to the credit of C.C.No.199 of of 2018 dated 03.11.2020 on the file of Judicial Magistrate Court, Rajapalayam, within a period of four weeks from the date of receipt of a copy of this order, failing which the sentence suspended shall stand automatically vacated and respondent is at liberty to execute the sentence imposed by the trial Court against the petitioner in the manner known to law."

2. In the said order, petitioners were directed to deposit 50% of the cheque amount to the credit of C.C.No.199 of of 2018 dated 03.11.2020, within a period of four weeks from the date of receipt of a copy of the order. However, they had not complied with the said order.

Today when the matter is taken up for hearing, learned counsel for petitioner submits that despite efforts they were unable to mobilize funds and thus was not able to comply with the direction of the Court. However, he would submit that petitioners undertakes to pay 50% of the cheque amount within a period of two weeks from the date of receipt of a copy of this order. The learned counsel for respondent has not raised any serious objections.

Considering the exceptional circumstances and peculiar facts of the case and considering the undertaking given by learned counsel for petitioners, this Court permits petitioner to deposit 50% of the cheque amount to the credit of C.C.No.199 of of 2018 dated 03.11.2020, within a period of two weeks from the date of receipt of a copy of this order. 3/5
