Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.2 to 4, in Crime No.94 of 2014 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 498(A), 406 and 506(i) of the Indian Penal Code read with Section 4 of Tamil Nadu Prohibition of Women Prohibition Act and hence, seek anticipatory bail.
2. The case of the prosecution is that the marriage between the first accused and the defacto complainant was solemnized on 05.04.2013. The petitioners, who are the in-laws of the defacto complainant, along with the first accused demanded more dowry from the defacto complainant. Hence, she has given a complaint against the petitioners.
3. The case of the petitioners is that they did not demand any dowry and they are innocent and they have been falsely implicated in this case.
4. The learned Government Advocate (Criminal Side) submitted that the investigation is pending.
5. Considering the facts and circumstances of the case and also considering the fact that the petitioners are in-laws of the defacto complainant, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Additional Mahila Court, Madurai and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent https://hcservices.ecourts.gov.in/hcservices/
police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.
