ORDER
Mr.M.Lingadurai, learned Special Government Pleader takes notice on behalf of the respondents.
2. Heard the learned counsel on either side and perused the materials available on records.
3. The petitioner seeks issuance of writ of mandamus to direct the respondent to issue patta to the petitioner in respect of the property comprised in T.S.No.31/5A, measuring an extent of 690 sq.ft., at Ward - Y, Block 3, Puthur Village, West Taluk, Trichy District.
4. The petitioner's application is based on the allotment of land to the said extent of 690 sq.ft., in favour of the petitioner's father, one Duraisami, way back in the year 1960. The said Duraisamy has executed his last Will bequeathing the subject property to his daughter, namely R.Dhanalakshmi, the petitioner herein. The said Will is dated 30th August 2004. The petitioner's father died on 23.04.2008 and the Will has come into effect. The petitioner has therefore requested the respondents to issue patta to the petitioner based on the allotment and the said Will. 2/4

The learned Special Government Pleader appearing for the respondents would submit that subject to satisfying themselves about the genuineness of the allotment made vide G.O.No.2521 of 1960 dated 08.06.1960, the 3rd respondent will consider the request of the petitioner for issuance of house site patta.

In view of the above, writ petition is allowed with a direction to the 3rd respondent to consider the petitioner's application subject to satisfaction of genuineness of the allotment order in favour of the petitioner's father and the relevant documents and thereafter, pass orders on the petitioner's application dated 02.12.2024 on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
