SIDE) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 457,380 and 511 of IPC, in Crime No.124 of 2016, on the file of the respondent police and hence, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused broke open the de facto complainant's house with iron rod and committed theft of the house hold articles. On complaint, a case has been registered against the petitioner.
3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.
4. The learned Government Advocate (Crl. Side) submitted that the petitioner is having three previous cases and co-accused viz., A1 and A3 were arrested and still in custody and the investigation of the case is pending.

5. Considering the fact that the co-accused viz., A1 and A3
have arrested and still in custody and that the petitioner is having three previous cases this Court is not inclined to grant anticipatory bail to the petitioner.
