Respondents PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure to direct the first respondent to transfer the investigation in Crime No.12 of 2014 on the file of the fourth respondent to the fifth respondent and to take action against the respondents 2 to 4 for delaying to exercise their file FIR, writing a fake date of complaint receipt and FIR and failing to exercise their statutory duty.

This Criminal Original Petition has been filed praying to direct the first respondent to transfer the investigation in Crime No.12 of 2014 on the file of the fourth respondent to the fifth respondent and to take action against the respondents 2 to 4 for delaying to exercise their file FIR, writing a fake date of complaint receipt and FIR and failing to exercise their statutory https://hcservices.ecourts.gov.in/hcservices/

2. The learned counsel for the petitioner submitted that the first complaint given on 22/1/2014 has not been taken on file. Thereafter, a second complaint was also given. The petitioner named a specific person by name Divya Priya, D/o.Rajendran, but no enquiry has been done against the said person.

3. The learned Government Advocate (Criminal Side) submitted that a special team has been constituted to nab the accused persons, as they are unknown.

4. It is a specific case of the petitioner that the named accused person has been involved in the alleged offence. There is nothing on record to show that any attempt has been made to enquire that person.

5. Considering the above facts and circumstances of the case, this Court is inclined to direct the first respondent to transfer the investigation from the fourth respondent to any other Officer under his control.(*)The first respondent superintendent of Police Trichy,is directed to monitor and Supervice the investigation.

6. With the above direction, this Criminal Original Petition is disposed of.
