ORDER
This contempt case has been filed complaining willful disobedience of the order dated 21.06.2024 in W.P.(MD)No.4496 of 2024.
2. While disposing the said writ petition, this Court directed the respondents therein, to consider the representation of the petitioner for seeking for compassionate appointment in a comprehensive manner without sticking to the fact that the petitioner's husband did not fall under the compassionate scheme and pass order on merits, within a period of four weeks from the date of receipt of a copy of this order.
3. The learned counsel appearing for the petitioner submits that the order of the Court is not complied with by the respondents within the time stipulated by this Court and as such, they are liable for punishment under the provisions of the Contempt Court Act.
4. On the other hand, the learned counsel for the respondents submits that against the order of the learned Single Jude, they preferred writ appeal and it is pending before the Hon'ble Division Bench of this Court. He further submits that the respondents intimated to the petitioner vide letter dated 16.04.2025 that her name is included in the compassionate appointment seniority list as per her application for appointment subject to outcome of the writ appeal.
5. The learned counsel for the petitioner accepted that he has received the letter dated 16.04.2025 from the respondents. However, he contends that in the said letter, the place of the petitioner in the said seniority list, is not mentioned and as such, the contention of the
respondents is doubtful. The respondent, who is present before this Court in compliance of the statutory notice, submits that the petitioner's name is in Sl.No.664 in the seniority list and as of now, 218 candidates were provided compassionate appointment and the remaining candidates will be provided compassionate appointment as per their turn, subject to the availability of the vacancy for compassionate appointment.
6. Considering the fact that the name of the petitioner is included in the seniority list for compassionate appointment, subject to outcome of writ appeal, in my considered view, no further adjudication is required in the present contempt case at present.
7. Accordingly, this Contempt Case is closed. Consequently, the Sub Application is also closed.
