BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 18.06.2019

CORAM:

THE HONOURABLE MR.JUSTICE V.BHARATHIDASAN W.P.(MD)No.13583 of 2019 Srinivasan : Petitioner

Versus

1.The Superintendent of Police, Sivagangai.

2.The Inspector of Police, Karaikudi South Police Station, Sivagangai District.

: Respondents Prayer:

Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to provide appropriate police protection on the petitioner's cost, during put-up fencing of our property in S.No.324/4, 7, Ariyakudi Village, Sivagangai District. For Petitioner : Mr.RM.Arun Swaminathan For Respondents : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.side) *****

O R D E R

This Writ Petition has been filed seeking a direction to the respondents to provide police protection.

2. Heard both sides.

3. The grievance of the petitioner is that he is the owner of the property in S.No.324/4,7 situated at Ariyakudi Village, Sivagangai District and he is also having a patta for the said property. Now, he is trying to put up a fence in the property, but, some unknown persons came to the spot and restrained the petitioner from putting up fence. Hence, he made a complaint before the respondents, but, no action has been taken so far. Hence, the present Writ Petition has been filed seeking the aforesaid relief.

4. On perusal of the materials available on record, it could be seen that some third parties are interfering with the possession of the petitioner. If the petitioner's possession is sought to be disturbed, the remedy available to him is to approach the Civil Court concerned seeking for a prohibitory injunction against the person interfering with his civil right, for which, the https://hcservices.ecourts.gov.in/hcservices/

police cannot give any protection to the petitioner. Thus, I find no merit in the Writ Petition and accordingly, the same stands dismissed. No costs.
