Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147 & 436 of I.P.C., in Crime No.80 of 2018, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that there is a dispute between the defacto complainant and the petitioner along with other accused persons with regard to selling pork business. Hence, the case has been registered for the above said offences.
3. The learned counsel for the petitioner submitted that earlier Crime No.94 of 2018 was registered at the instance of petitioner side and therefore, the defacto complainant has given a false complaint against the petitioner and other accused persons and the present FIR has been registered and that there is a business motive between the parties with regard to selling pork and prays for anticipatory bail in favour of the petitioner.
4. It is submitted by the learned Government Advocate (Criminal side) that there is no bad antecedents against the petitioner.
5. Taking note of the background of the facts of this case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be https://hcservices.ecourts.gov.in/hcservices/
released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Virudhunagar, and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
