To condone the delay of 177 days, in filling this Second Appeal, and direct the Second Appeal to the taken on file and thus render justice.

ORDER

I have gone through the affidavit filed in support of this petition for condoning the delay of 177 days in filing the Second Appeal. 2.I have also heard the learned Counsel for the parties and I am satisfied that the delay is neither inordinate nor wanton. Substantial reasons have been set out for not preferring the second appeal in time. However, at the same time, delay has caused some prejudice to the contesting respondents. Hence, I am inclined to allow this petition on payment of Rs.3,000/- [Rupees Three Thousand only] to the learned Counsel for the respondents, on or before 29.03.2026.
