ORDER

Seeking to quash F.I.R in Crime No.35 of 2026 on the file of the 1st respondent, this criminal original petition is filed.

2. Since no adverse order is passed against the 2nd respondent, notice to the 2nd respondent is dispensed with.

3. The learned counsel for the petitioner submitted that the petitioner is a sole accused in the said crime. The case of the prosecution is that on 08.12.2025, the petitioner had driven a Royal Enfielf two wheeler bearing the word "Thalaivar" on the front number plate on the Abiramam to Kamuthi Main Road in a rash and negligent manner causing inconvenience to the general public and recorded the same and uploaded a reel in Instagram in the ID 'tvk-sarann'. Following which F.I.R in Crime No.35 of 2026 came to be registered for the offence under Section 281 of BNS, 2023.

4. The learned counsel for the petitioner submitted that the petitioner will not ever display the word Thalaivar in his number plate any further. However, he made it clear that he never performed any wheeling.

5. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering his young age, this Court required the petitioner to file an affidavit undertaking that he will not display any unnecessary words violating the mandates of Motor Vehicles Act, 1988 in the number plate and perform wheeling or cause any inconvenience to the general public in future. In this regard, the petitioner had filed an affidavit dated 25.02.2026 submitting that already a Challan has been issued by the respondent police imposing a fine of Rs.2,500/-. Directing the petitioner to promptly pay the said amount and accepting the undertaking affidavit filed by the petitioner, the impugned F.I.R in Crime No.35 of 2026 on the file of the 1st respondent is quashed. undertaking affidavit, dated 25.02.2026 shall form part and parcel of the order.
