Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 3rd respondent to conclude the enquiry and to take necessary action within a stipulated time as fixed by Hon'ble Court to include the name of the petitioner in Patta No.658 as a joint pattadhar in pursuant to the Old S.No.372/14 and New S.No.6/14 of Pullambadi Village to an extent of 0.11.00 ares on the basis of representation dated 21.11.2024.

ORDER

Mr.M.Lingadurai, learned Special Government Pleader takes notice on behalf of the respondents.

2. The petitioner seeks issuance of writ of mandamus to direct the 3rd respondent to conclude the pending enquiry based on the petitioner's application to include his name in the joint patta.

3. Considering the limited scope of relief sought for in the writ petition, with the consent of the learned counsel on either side, the writ petition itself is taken up for final disposal.

4. The petitioner has made a representation to the respondents 1 to 3 to include his name in patta on 21.11.2024. In furtherance thereof, the 1st respondent has directed the 3rd respondent to consider the said representation of the petitioner by proceedings dated 23.12.2024. In fact earlier the 2nd respondent has forwarded the application of the petitioner to the 3rd respondent to take action.

5. The grievance of the petitioner is that despite respondents 1 and 2, issuing direction to the 3rd respondent to consider and pass orders on the petitioner's representation, 3rd respondent has not passed any orders and enquiry is still pending on the file of the 3rd respondent.

6. It is an admitted case that the petitioner's application to issue patta including his name in the joint patta is pending right from November 2024. Even superior authorities namely respondents 1 and 2 called upon the 3rd respondent to pass orders on the petitioner's representation even in December 2024.

7. In view of the above, it would be suffice to issue a direction to the 3rd respondent to include the petitioner's name in the joint patta based on the petitioner's representation dated 21.11.2024 and pass orders on merits and in accordance with law, after hearing the necessary interested parties. The said exercise shall be completed within a period of 8 weeks from the date of receipt of a copy of this order.

8. With the above observations, writ petition is disposed of. No costs.
