For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.645 of 2019 on the file of the respondent police ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent Police for the offences under Sections 8 (c) and 20 (b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.645 of 2019.

2. According to the prosecution, on 29.12.2019, based on a specific information, a Police team has proceeded to Mallanampatti Village and keeping surveillance that certain persons selling contraband and they rounded Pandiammal, w/o. Kathiresan and Annakodi, W/o.Palraj and they found in their possession 1 Kg and 500 grams of Kanja pocket. Based on their information, they found that the present petitioner is their superior.

3. The learned Government Advocate (Criminal side) appearing for the State submitted that the petitioner herein is a habitual offender and there are several cases pending against her under the NDPS Act.

4. The learned counsel appearing for the petitioner would submit that nothing was recovered from the petitioner herein and she is an innocent person. The present case has been falsely foisted against her.

5. The respondent Police has roped this petitioner as Accused No.4 based on the confession statement given by the person from whom the contraband has been seized and the petitioner herein appears to be the supplier of the contraband. Unless and until, she is secured by the Police, the illicit sale of kanja cannot be prevented and the investigation in this case will also get tampered, if the petitioner is granted anticipatory bail. Hence, this Criminal Original Petition stands dismissed.
