O R D E R
This Criminal Original Petition has been filed to direct the Special Court of TNPID Act cases, Madurai to expedite and dispose the case in C.C.No.39 of 2013, within a time frame as fixed by this Court.
2.Heard the learned Counsel appearing for the petitioner, the learned Government Advocate(Criminal side) appearing for the respondent.
3.Based on the complaint lodged by the petitioner, a case was registered in Crime No.78 of 2009, for the offences punishable under Sections 406 and 420 IPC against the accused persons, on the file of the respondent police, on 06.11.2009. After filing the final report, the case was taken on file by the learned Special Court under TNPID Act, 1997 Madurai under Sections 406, 420 and 120B IPC and Section 5 of TNPID Act, in C.C.No.39 of 2013. 4.The learned Counsel for the petitioner submitted that even though the case was registered on 06.11.2009 and the same was taken on file by the learned Special Court under TNPID Act, 1997 https://hcservices.ecourts.gov.in/hcservices/
Madurai, in the year 2013, there is no progress in the trial. Hence, the petitioner has constrained to file petition to expedite and dispose of the trial in C.C.No.39 of 2013. 5.The learned Government Advocate, fairly submitted that he will take steps to complete trial within a period of six months. 6.Having regard to the facts and circumstances of this case and the submission made by the learned Government Advocate, this Court direct the Special Court of TNPID Act Cases, Madruai, to dispose of the case in C.C.No.39 of 2013 within a period of six months from the date of receipt of copy of this order. 7.Accordingly, the Criminal Original petition is allowed.
