PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the entire records of the 1st respondent, pertaining to the Notification and Prospectus-2024-2025 of Madurai 2/8
Kamaraj University dated 08.07.2024 calling for online application - common entrance test - for admission to Ph.D., program- published by Madurai Kamaraj University through official university Website and a few daily Newspapers, on his file and quash the same directing the respondents to a Court-monitored investigation preferably by Special Investigation Team (SIT) or any other appropriate Investigating Agency as the Hon'ble Court may deem fit into the charges of corruption and other malpractices regarding the said Common Entrance Test (CET) and submit final report to the Hon'ble Court in the matter within a time frame to be fixed by this Court.

ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The common entrance test notification for admission to Ph.D (full time / part time) programmes 2024-25 is under challenge in this Writ Petition. 3/8
2.The applications were invited for Ph.D. Programmes of Madurai Kamaraj University through common entrance test. The petitioner is a retired English Professor and currently, a practising Advocate in the High Court of Madras at Madurai Bench. The grievance of the petitioner is that illegalities and irregularities have been committed to admit the students to undergo Ph.D., programmes in Madurai Kamaraj University.
3.The petitioner in person would contend that larger scale of illegalities and irregularities into the affairs of the Madurai Kamaraj University caused great concern for the public and the institutional integrity is completely scattered. Thus, he has chosen to file this Public Interest Litigation. Admittedly, the petitioner in person is not an applicant nor connected with the common entrance test. He has filed this Writ Petition as Public Interest Litigation. 4.The learned counsel appearing for the 1st respondent filed typed set of papers, which would indicate that the Government has taken note of the illegalities and irregularities, based on the complaint received from various factors and appointed High Level Committee to conduct enquiry into the allegations, relating 4/8
to the admission and other affairs of Madurai Kamaraj University. The enquiry is admittedly pending.
5.Admittedly, the admission list has not been published so far. In view of the fact that the High Level Committee appointed by the University is in the process of conducting enquiry, publication of admission list should be made only after the completion of enquiry in all respects by the High Level Enquiry Committee and final decision is taken on the allegations of the illegalities and irregularities.
6.The petitioner in person is at liberty to submit all the documents available with him along with statements if any to the High Level Committee and on receipt of any such documents / complaints or statements, the High Level Committee shall take into consideration the same, while conducting enquiry. If necessary, the petitioner in person may be provided personal hearing by the High Level Committee, since he is a retired English Professor in Madurai Kamaraj University, which may be a conversion with the affairs of the University. 5/8
7.In view of the facts and circumstances of the case, the 1st respondent is directed to expedite the enquiry process and complete the same as expeditiously as possible and thereafter, take a decision on merits and in accordance with law. Till such final decision is taken, admission list shall not be published by the 1st respondent.
